In short. Appesi is a diary that lives on your phone. What you put in it is yours and stays yours. Almost everything is free; Premium is a yearly subscription and unlocks three features. Apple handles the subscription, and you can cancel it whenever you like from your iPhone settings.
1. Who provides the service
Appesi is developed and distributed by Gurini Pier Giacomo (“the developer”). Contact: jeck.dev820@gmail.com.
2. Acceptance
By downloading and using Appesi you accept these terms. If you do not accept them, do not use the application. Apple’s standard end user licence agreement also applies: where it governs a point and the two conflict, that agreement prevails.
3. Licence to use
You are granted a personal, non-exclusive, non-transferable licence to install and use Appesi on Apple devices you own or control, under App Store rules. You may not decompile, disassemble or attempt to derive the source code of the application, except to the extent the law permits, nor resell, rent out or distribute modified copies of it.
4. Your content
The photographs, videos, thoughts, captions and films you create with Appesi are and remain entirely yours. They stay saved on your device: the developer has no access to them, acquires no rights over them, and cannot recover them on your behalf.
You are responsible for what you put in the diary and for respecting other people’s rights, including those of anyone appearing in your photographs and videos, particularly if you decide to share a film with others.
Backups are up to you. Because the diary is local, losing or replacing the device means losing its contents unless you have exported a backup file. Do it regularly and keep it somewhere safe. The developer cannot restore lost content in any way.
5. Music, artwork and branding
The music tracks available for the monthly film, the backdrops, the frames, the illustrations, the name “Appesi”, the logo and every other graphic element of the application are owned by the developer or duly licensed to the developer.
You may use them within the films you create with the app, and keep, rewatch and share those films, including on social networks, for personal, non-commercial purposes. You may not extract the music or the artwork to use them separately from the app, redistribute or resell them, include them in compilations, or use them in commercial productions.
6. Free features and Premium
These are and will remain free: writing the diary, adding past memories by hand, three-second videos, browsing, the calendar, all styling options, the reminder, backup and restore.
The Premium subscription unlocks three features only, for an unlimited number of months:
- Fill the days — automatically recovering a month of memories from your photo library;
- The film of the month — creating the summary film;
- Longer videos — video memories of five or seven seconds, instead of the three seconds always available.
6.1 The free months
Before subscribing you may use each of the first two features free of charge on one month of your choosing: one month for filling and one month for the film, independent of each other. The choice is fixed the first time the feature completes successfully and is final for that feature; on the chosen month you may then work as many times as you like, with no expiry.
Longer videos have no trial month: they stay available for the whole subscription period, and videos already saved at five or seven seconds are not shortened when it ends.
Free trials are recorded on the device alone: they are not tied to an account, do not sync between devices, are not included in exported backups, and do not survive a device reset.
6.2 Price, renewal and cancellation
- The subscription is yearly. The applicable price is the one the App Store lists for your country and that the application shows before you confirm the purchase; it may differ between countries because of taxes and exchange rates. Any price change is communicated by Apple and does not apply to a period already paid for.
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically every year unless cancelled at least 24 hours before the end of the current period. Renewal is charged within the 24 hours before expiry.
- You can manage or cancel the subscription at any time in Settings › your name › Subscriptions on your iPhone, or from the dedicated button on the app’s Premium screen. Cancellation takes effect at the end of the period already paid for.
- Refunds, receipts and billing matters are handled exclusively by Apple through reportaproblem.apple.com. The developer does not collect payment directly and cannot issue refunds.
- If you are buying as a consumer, the statutory right of withdrawal is exercised against Apple, under App Store terms.
When the subscription expires or is cancelled, everything you have already made remains available: saved films, imported memories and the diary are untouched. Only new Premium-only operations stop, apart from the free months, which remain usable.
7. Fair use
You agree not to use Appesi for unlawful purposes, not to circumvent purchase checks or Premium feature limits, and not to interfere with the operation of the application or of the third-party services it relies on.
8. Availability and changes
The application is provided “as is”. The developer works to keep it running and up to date, but cannot guarantee that it is free of errors, nor that it will remain compatible with future versions of iOS or with unsupported devices. Features may be changed, added or removed in updates; if a paid feature were discontinued in a substantial way during a period already paid for, you will be informed.
Some features depend on third-party services (the App Store, Apple’s geocoding services, RevenueCat) whose availability is outside the developer’s control.
9. Liability
To the extent permitted by law, the developer is not liable for indirect damages arising from use or inability to use the application, including loss of content caused by device failure, loss or replacement, by uninstalling the app, or by not having made a backup.
Nothing in these terms limits or excludes liability for wilful misconduct or gross negligence, nor the mandatory rights the law grants to consumers.
10. Privacy
How data is handled is described in the privacy policy, which forms an integral part of these terms.
11. Changes to these terms
These terms may be updated. The version in force is always the one published on this page, with its date. Material changes will be flagged inside the application and do not apply retroactively to a subscription period already paid for.
12. Governing law and jurisdiction
These terms are governed by Italian law. For disputes with users acting as consumers, the courts of the consumer’s place of residence or chosen domicile have exclusive and mandatory jurisdiction. For any other dispute, jurisdiction is determined under Italian law.
